The judicial system – gender aspects

Language: the apparently gender neutral wording of the law of often male connoted. If women are rendered visible in the law, this is often to do with their physicality – their bodies. Legal norms are therefore usually oriented to male ways of life and often have a discriminatory impact on women. Gender Mainstreaming can provide impulses for wording legal norms in a way that does justice to gender.

Criminality: criminal acts are predominantly committed by young men. Are men more criminal than women? Data collected in a gender nuanced way do not on their own stop criminological research from naturalizing gender differences. Surveys taking gender as a central analytical category note that young women are subject to far less state control, as their social control functions mostly via the private sphere. Can new strategies be developed on the basis of such findings to avert deviant behavior?

Heterosexual norm: heterosexual couples are assumed to be the norm in matrimonial and family law. How can it be ensured that planned legislation in this area guarantees people with same-sex partners or alternative concepts of family equality of opportunity?
